Abstract The established practice of using silent forces, tools and methods by police and special services of different countries, whose purpose is to counter crime and its organized forms, certifies that the first among them, even with the effectiveness of the latest methods of electronic intelligence and scientific and technological progress, is rightly confidential cooperation.
Confidential cooperation is one of the most effective and efficient methods of operational and search activity and is widely used by operational units when it is necessary to solve complex problems of prevention, detection, termination and disclosure of criminal offenses. This method is used by investigators and prosecutors in criminal proceedings that use information obtained as a result of confidential cooperation and prosecutors, who oversee law enforcement by law enforcement agencies in verifying compliance with applicable legislation on the compliance of operational and search activities, goals and objectives of operational search activities, compliance with statutory conditions and procedures for conducting operational search activities, as well as with involving citizens in their implementation on a confidential and voluntary basis. Therefore, it is very important to clarify the principles on which the operations of operational units are based in confidential cooperation.
The purpose of the article is to study and systematize the principles of activities of operative units during confidential cooperation.
It is stated that confidential cooperation as an integral part of operational search activity is based on the same principles as operational search activity, but has certain peculiarities in view of the tacit nature during the event: from the stage of establishing confidential relations until their completion.
The principles of operational search activity are inherently imperative, state-governmental in nature and contain mandatory provisions that must be observed by all subjects of operational search activity.
It is concluded that the principles of confidential cooperation are guiding principles that neglect the activities of operational units. Analyzing the principles of operational and search activities, the authors have identified the most necessary of them during confidential cooperation.
The article states that the legal as well as practical importance of the principles of activities of operative units during this type of cooperation lies in the fact that they occupy the main place in the system of legislative support of activities related to the confidential work of operational units and at the same time provide a combination of legal requirements and the procedure for their practical implementation in the activities of authorized operational units during the establishment and implementation of confidential cooperation.
